An estate plan comprises a number of documents that differ for every person, but typically include a trust or will, powers of attorney, and documents for end of life. It gives you control over who has authority over your estate. If you have no estate plan, the government may choose who controls your estate. An estate plan helps provide for your immediate family, while reducing the costs and burden on your family of settling your estate.
A trust is a private document that is used primarily to avoid probate, reduce estate taxes, preserve your privacy, and manage your financial affairs. Most people that create a trust do so to quickly and efficiently move their assets to their loved ones without the need of court action. A trust is often the best option for individuals who own any kind of real property (land, house, rental property, vacation home, etc.).
A will is a document that tells a court who is going to inherit your property, and who you want to be your personal representative after your death. A will is a relatively inexpensive estate planning option during your lifetime, but your loved ones will have to file it in court after your death, which can often be expensive and time consuming for them.
